Welcome to Octa‑Sanctum Solutions®. By accessing or using our services, systems, or website (octa-sanctumsolutions.co.ke), you agree to be bound by the following Terms and Conditions. If you do not agree with these terms, please do not use our services.

• "Company" refers to OctaSanctum Solutions®, a Kenyan-based digital solutions provider.
• "User" means any person or entity that accesses or uses our website, ERP systems, modules, or related services.
• "Services" refers to all platforms, software, tools, support, and modules provided by OctaSanctum Solutions®.

2. Use of Services

You agree to use our services in compliance with all applicable laws and these Terms. You may not:

• Use the platform for any unlawful purpose.
• Copy, reverse-engineer, or resell our systems or modules.
• Disrupt or compromise the system’s security or data integrity.
• Use automated scripts or bots to access or extract data.

3. Account Responsibility

Users are responsible for maintaining the confidentiality of their login credentials and for all activities under their account. Please notify us immediately if you suspect unauthorized use.

4. Data Protection & Privacy

All personal data collected is processed in accordance with our Privacy Policy and applicable data protection laws such as the GDPR and Kenya Data Protection Act (2019).

5. Secure Login and Access

Users are required to log in securely using credentials that are validated on our servers. We do not store login credentials in cookies. Instead, we use cryptographically secure, time-limited tokens managed server-side.

This ensures that your login data cannot be intercepted or reused by malicious actors, further protecting your session against unauthorized access.

6. Intellectual Property

All content, code, modules, logos, trademarks, and design components of the Octa‑Sanctum Solutions® platform are the intellectual property of the Company. Unauthorized use or redistribution is strictly prohibited.

7. Licensing and Access

Users are granted a non-exclusive, non-transferable license to use our systems based on the subscribed plan (Starter, Professional, Enterprise). Enterprise features may include custom deployments, hybrid hosting, and offline modules as agreed contractually.

8. Payment Terms

All services are billed based on the agreed plan. Invoices are payable within 7–30 days depending on the agreement. Failure to pay may result in suspension or termination of access to services.

9. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted access. Scheduled maintenance or unforeseen outages may occur. We’ll always aim to notify users in advance via email or dashboard alerts.

10. Termination

We may suspend or terminate your access if you breach these terms or misuse our systems. You may also terminate your subscription at any time, but no refunds are issued for prepaid periods unless legally required.

11. Limitation of Liability

OctaSanctum Solutions® shall not be liable for indirect, incidental, or consequential damages resulting from your use of our services. Our total liability, in any case, shall not exceed the subscription fees paid by you in the last 3 months.

12. Force Majeure

We are not liable for failure or delay in performance due to events beyond our control, such as natural disasters, war, internet outages, or government restrictions.

13. Amendments

We may update these Terms from time to time. Continued use of our services after changes implies acceptance of the new Terms. The latest version will always be available on our website.

14. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising will be resolved in Kenyan courts unless otherwise mutually agreed.
